1. Acceptance of Terms

By accessing or using the Kōru platform ("Service"), you confirm that you: (a) are at least 18 years of age; (b) have read and understood these Terms; (c) agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. The Service

Kōru is a general wellness platform providing AI-powered tools for fitness tracking, nutritional logging, mindfulness practices, journaling, and wellness coaching. The Service is operated by Koru Labs LLC ("we", "us", "our").

3. ⚠️ Health & Medical Disclaimer — Critical

• You should consult a qualified medical professional before starting any new exercise programme, diet, or wellness routine
• If you have a pre-existing medical condition, injury, or health concern, seek professional medical advice before using Kōru features
• AI-generated nutrition goals are estimates based on general formulas (Mifflin-St Jeor) and are not personalised medical nutrition therapy
• AI-generated workout plans are general fitness suggestions and do not account for undisclosed health conditions
• Kōru's mindset and spiritual content is for personal reflection only and is not a substitute for mental health treatment
• Koru Labs LLC accepts no liability for injury, illness, or adverse health outcomes resulting from use of the Service

4. AI-Generated Content Disclosure

Kōru uses artificial intelligence to generate personalised content including workout plans, meal suggestions, nutrition analysis, journal reflections, and coaching responses. You acknowledge that:

• AI-generated content is automatically produced and may contain errors or inaccuracies
• AI-generated content is not reviewed by qualified medical, nutritional, or fitness professionals before delivery
• Your profile data is sent to Google Gemini (our AI provider) to generate responses — see our Privacy Policy
• AI coaching is not a substitute for human professional coaching, therapy, or medical advice
• You use AI-generated content entirely at your own risk

5. ⚠️ Nutrition & Dietitian Disclaimer

• Calorie and macro goals are estimates based on general population formulas (Mifflin-St Jeor BMR) and are not personalised medical nutrition therapy.
• AI meal plans are generated for general wellness purposes and may not be appropriate for individuals with diabetes, eating disorders, kidney disease, cancer, pregnancy, or other conditions requiring clinical dietary management.
• If you have a medically complex dietary need, please consult a Registered Dietitian or your physician before following any AI-generated meal plan from Kōru.
• Koru Labs LLC does not hold, and does not claim to hold, any dietitian, nutritionist, or nutrition therapy licence.
• Nothing in the Kōru platform constitutes a diagnosis, treatment recommendation, or clinical dietary prescription.

6. ⚠️ Food Allergy & Ingredient Warning

• You are solely responsible for verifying the ingredients of every meal you prepare or consume, regardless of what the Kōru platform suggests.
• AI-generated meal suggestions may contain hidden allergens, cross-contamination risks, or ingredient variants that contain your allergen under a different name.
• Koru Labs LLC accepts no liability whatsoever for any allergic reaction, anaphylaxis, or adverse health event arising from reliance on AI-generated meal plans or food suggestions.
• Always read food labels. When dining out, always disclose your allergy to the establishment directly.
• If you have a severe or life-threatening allergy (e.g. peanut, tree nut, shellfish), we strongly recommend consulting a Registered Dietitian for a medically supervised meal plan.

7. Eligibility & Account

• You must be at least 18 years old to use Kōru
• You must provide accurate and truthful information during signup and onboarding
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorised account access
• One person may not maintain multiple accounts

8. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Upload, share, or transmit content that is harmful, abusive, or illegal
• Attempt to access other users' accounts or data
• Reverse engineer, decompile, or extract source code from the platform
• Use automated scripts, bots, or scrapers on the platform
• Impersonate another person or entity
• Harass, threaten, or harm other users through community features
• Submit false health or fitness information with intent to mislead the AI

9. Subscription & Billing

Kōru offers two paid plans — Core ($9/month) and Premium ($19/month) — each with a 14-day free trial. The following billing terms apply:

• You authorise recurring billing on the date of subscription
• Subscriptions auto-renew unless cancelled before the renewal date
• You may cancel at any time — cancellation takes effect at the end of the current billing period
• No refunds are provided for partial months
• We reserve the right to change pricing with 30 days' notice

10. Intellectual Property

• Koru Labs LLC owns all rights to the Kōru platform, branding, technology, and AI-generated content
• You own the content you create (journal entries, notes) — you grant us a licence to process it to provide the Service
• You may not reproduce, distribute, or commercialise any part of the platform without written permission

11. Privacy & Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms. By agreeing to these Terms, you also agree to our Privacy Policy.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KORU LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, ILLNESS, ALLERGIC REACTION, LOSS OF DATA, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim (or $100 if you are a trial user).

14. Indemnification

You agree to indemnify and hold Koru Labs LLC harmless from any claims, losses, or damages (including legal fees) arising from your violation of these Terms, your use of the Service, or your infringement of any third-party rights.

15. Termination

• You may delete your account at any time through the Settings page
• We may suspend or terminate your account for violations of these Terms
• Upon termination, your right to use the Service ceases immediately
• We will delete your personal data within 30 days of account deletion (consent records retained for 7 years as required by law)

16. Changes to Terms

We may update these Terms from time to time. We will notify you by email and in-app notification at least 14 days before significant changes take effect. Continued use after the effective date constitutes acceptance.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas, USA.
